BACKGROUND
The UK left the EU in January 2020 and the transitional period which has limited disruption so far is due to end on 31 December 2020. There is uncertainty about the future relationship between the UK and the EU and it has been a significant area of focus for continuity planning for Decoded over the last 18 months.
SUMMARY
In response to COVID-19 we have moved all delivery of our services to virtual delivery platforms. This means we will not be impacted by changes to travel rules and right to work regulations. As a result we do not foresee any major barriers to continuing to provide services other than Data Sharing as laid out below.
DATA SHARING
There are complications for Data Sharing in the event of a No Deal Brexit which would see the UK become a “third country” under the GDPR regulations. The European Commission is currently deciding whether the UK Data Protection laws should be granted “equivalency” under GDPR but as it stands in December 2020 no decision has been made.
In order to allow data to continue to be shared between Decoded and our clients in the event of both a no-deal outcome and equivalency not being granted we are undertaking a process of putting in place Standard Contractual Clauses to govern the sharing of data.

CONTINGENCIES
Whilst we are confident that in the immediate term (January to April 2021) Brexit will have minimal impact on our operations and ability to continue to deliver services in the EU we do have contingency plans in place if necessary and we will continue to keep you updated if we need to pursue those plans.
